Services

We provide performance based digital advertising services, including Google Ads and Meta Ads management.

Performance Based Billing

We only bill when a minimum 2x return on ad spend is achieved.

This 2x ROAS requirement is a billing condition only. It is not a guarantee of results, revenue, or profitability.

Commission Structure

6 percent of revenue generated through ads managed by The Social Scalers, up to USD 250,000 per calendar month.
4 percent of revenue generated through ads managed by The Social Scalers above USD 250,000 per calendar month.

Revenue is calculated using the native dashboards of the advertising platforms unless otherwise agreed in writing.

No Guarantee of Returns

We do not guarantee profits, revenue, growth, or advertising performance.

Advertising outcomes depend on factors outside our control, including product quality, pricing, demand, website conversion rate, competition, platform algorithms, and customer behaviour.

Invoicing and Payment

Invoices are issued automatically within the first five working days of each new month.

By engaging our services, you authorise automatic billing of all invoices issued under this agreement.

Failure to pay may result in suspension or termination of services.

Client Responsibilities

You are responsible for
Providing accurate information and platform access
Compliance with all applicable laws and regulations
Product fulfilment, customer service, and refunds

Limitation of Liability

The Social Scalers LLC is not liable for
Loss of revenue or profit
Advertising spend losses
Account suspensions or enforcement actions by advertising platforms
Indirect, incidental, or consequential damages

This limitation applies to all claims to the fullest extent permitted by law.

Third Party Platforms

We are not responsible for actions taken by third party platforms including Google, Meta, or any contracted fulfilment or technology partners.

Termination

Either party may terminate services with written notice, subject to any outstanding fees owed.

Governing Law

These Terms are governed by the laws of the State of Wyoming, United States.
